Effective date: [EFFECTIVE_DATE] Operated by: [LEGAL_ENTITY_NAME] ("Career Hawk," "we," "us," or "our"), [STATE] [ENTITY_TYPE, e.g. LLC]. Contact: [SUPPORT_EMAIL]
By creating an account or using careerhawk.ai (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. The Service
Career Hawk is an informational tool that helps you discover job postings, scores how well postings may fit your background, and helps you prepare application materials. The Service aggregates publicly available job-posting data from third-party sources and applies automated and AI-assisted analysis.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information you provide.
3. Accounts
You are responsible for safeguarding your account credentials (managed via our authentication provider) and for all activity under your account. Notify us promptly of any unauthorized use.
4. Acceptable use
You agree not to:
- use the Service to violate any law or third party's rights;
- scrape, resell, or redistribute data obtained from the Service;
- attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its infrastructure;
- submit false information or impersonate others;
- use the Service to send spam or mass-apply in a manner that abuses employers or third-party job platforms.
5. No guarantee of employment; informational only
The Service does not provide career, legal, financial, or professional advice. Job scores, recommendations, company information, and generated materials are informational and produced in part by automated and AI systems that can be inaccurate or incomplete. We do not guarantee any job, interview, offer, or outcome. You are solely responsible for decisions you make and materials you submit. Verify all job postings, company details, and application requirements directly with the source before relying on them.
6. Third-party content and links
Job postings and company data originate from third parties. We do not control and are not responsible for the accuracy, availability, or practices of those sources or any employer. Your interactions with employers and third-party sites are solely between you and them.
7. AI-generated content
The Service uses AI models (including third-party providers) to analyze postings and generate materials such as tailored resumes. AI output may contain errors or fabrications. Review all AI-generated content before use. You own the materials you create using the Service, subject to these Terms.
8. Subscriptions and billing
The Service may offer free and paid tiers. Paid features, pricing, billing cycles, and refund terms (if any) will be disclosed at the point of purchase and are incorporated by reference. [BILLING_TERMS_TBD]
9. Intellectual property
We and our licensors own the Service, including software, design, and trademarks.
Portions of the underlying job-finding engine are used under the MIT license (see
THIRD-PARTY-NOTICES.md). We grant you a limited, non-exclusive, non-transferable
license to use the Service for your personal job search.
10. Termination
You may stop using the Service at any time and delete your account. We may suspend or terminate access for violation of these Terms or to protect the Service. Upon termination, your right to use the Service ends; data handling is governed by our Privacy Policy.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [LEGAL_ENTITY_NAME] WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.
13. Indemnification
You agree to indemnify and hold harmless [LEGAL_ENTITY_NAME] from claims arising out of your use of the Service, your content, or your violation of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-laws rules. [ARBITRATION_CLAUSE_TBD — consider binding arbitration and class-action waiver; have counsel draft.] Venue for any non-arbitrable dispute lies in the state or federal courts located in [COUNTY, STATE].
